La Merenda by Dominique Le Stanc, Inc. (the “Company”) is committed to protecting the privacy of its Users (as defined below). The terms “you”, and/or “User” shall refer to the users of lamerenda.com (the “Website”) and those individuals’ related entities, successors, assigns, shareholders, directors, officers, members, employees and agents. This privacy policy (“Privacy Policy”) outlines the information collected by the Company from its Users through the Website and how that information is used. 

This Privacy Policy is incorporated into the Agreement as defined within the Terms and Conditions page of the Website. By using the Website, you agree to be bound by this Privacy Policy, the Terms and Conditions, and the Agreement. Any offer by a User to modify the terms of this Privacy Policy is expressly rejected.

By using the Website, You further agree and expressly consent to the data collection and sharing practices of the Company as described in this Privacy Policy.  Without limitation, you specifically agree that the Company may collect all of the information about you, and may use and share that information, as described in this Privacy Policy.

If YOU do not agree with the terms of this Privacy Policy, or any updated terms hereto, YOUR ONLY RECOURSE IS TO discontinue use of the Website immediately.

A User acting on behalf of an employer or entity acknowledges that they are authorized to do so and that they may be sharing certain corporate information with the Website and other Users.  As further set forth in the Terms and Conditions, all Users also acknowledge that they have permission to utilize the Website in this capacity.

Please note that, to the greatest extent allowed by law, the Company reserves the right to revise, change, amend, alter or modify this Privacy Policy and other policies and agreements incorporated into the Website at any time and in any manner, without notice. Any such changes shall be effective immediately upon posting, unless otherwise stated. Your continued use of the Website constitutes acceptance of those changes. Information Collected

The information which the Company collects through the Website may include personally identifiable information (“Personal Information”), which refers to information that helps the Company identify Users of the Website. The Personal Information includes, but is not limited to, data such as a User’s

  • geolocation data,
  • IP address, and/or
  • any other information voluntarily submitted by a User on the Website.

The Website may also collect data that cannot be traced back to a specific individual (“Anonymous Information”).  For example, the Company may collect, through the use of browser cookies, web beacons, or similar tracking technologies (i) how many Users have viewed the Website and specific content therein; (ii) keywords utilized to find the Website; (iii) keywords utilized to search within the Website; and (iv) the geolocation and/or zip code of the Users.

The Company’s use of web beacons or similar tracking technologies may also allow the Company to track how the Website is used, and collect additional Anonymous Information including, without limitation (i) the name of the User’s internet service provider; (ii) the IP address of the User’s computer; (iii) a User’s browser software and operating system; (iv) the identity of any linked-form or linked-to website; and (v) other similar information.

Users who view the Website but do not enter their Personal Information are generally anonymous Users. 

The Company may combine a User’s Anonymous Information with similar information collected from other Users to help improve the Website and the Company’s services and for marketing and other internal uses. 

User acknowledges and agrees that the Company may share User’s Anonymous and Personal Information with its employees, independent contractors and service providers as it deems necessary for the Company to effectuate the purposes of the Website. 

Be advised that the Company utilizes several services in the creation, maintenance, marketing and operation of its Website.  The Company does not own or operate these services and as such does not make any warranties with respect to these services, the companies that provide them, and the Personal and Anonymous information that they may independently collect.  These services include, but are not necessarily limited to, Google Analytics, Alphametic, and Shopify. The Company may, at any time and without prior notice, change the services it uses to create, maintain and operate its Website.  Please refer back to this page, as well as the Terms and Conditions page, to stay apprised of any changes.

Notwithstanding the foregoing, the Company does not currently knowingly store credit card numbers on its servers.  All credit card information and identifying information is processed through an independent third-party as made available through the Website (“Payment Processor”).  The current Payment Processor is Shopify. For more information regarding Shopify’s privacy measures, you may visit https://www.shopify.com/legal/privacy. The User acknowledges that the Payment Processor is an independent third party with no affiliations with the Company.  Accordingly, Company cannot attest to or otherwise be responsible for the acts of the Payment Processor, including without limitation, its collection and use of information. User acknowledges that it is his sole responsibility to investigate the Payment Processor’s policies and to ensure that he is satisfied with the same. User provides his information to the Payment Processor at his own risk.  Moreover, User will be solely responsible for complying with the terms and conditions of the User’s agreement with the Payment Processor, which may include, but is not limited to, the way the Payment Processor collects information, the manner in which they process payments and the duties and obligations that the User has with the Payment Processor. The Company does not know of the policies of independent third-parties, including the Payment Processor, and is not responsible for the information collected or how the information is used by any third-parties, including, without limitation, the Payment Processor.

If the User believes that he has been mistakenly billed, the User has the duty and obligation to notify the Payment Processor immediately of such error. The User must review the Payment Processor’s policy with regard to their notice requirement. The User releases the Company and the Website from all liabilities and claims of loss resulting from any error or discrepancy in billing the Company and the Website from all liabilities and claims of loss resulting from any error or discrepancy in billing.

Online Tracking

Your browser may incorporate a “do not track” setting that can be enabled, which will send a signal to websites indicating that you do not wish to be tracked. However, the Website does not currently respond to these signals and there is no mechanism for users to opt-out of the Website’s tracking.  If you do not wish the Website to collect any Personal Information through tracking, your sole recourse is to not use the Website.

REGISTERED USERS

In addition to the aforementioned information collected, Users leaving a review of the products (“Reviewers”) and Users purchasing goods from the Website (“Purchasers”) (collectively, “Registered Users”) will be asked to provide certain additional Personal Information.  All Registered Users will be asked to provide information such as their name and e-mail address. The website may also log all actions Registered Users take while using the Website.

Purchasers will be asked to provide, without limitation, Personal Information including, without limitation, Purchaser’s name, physical address including state and country, telephone number, and email address. The Personal Information is collected in order to allow for greater ease in Purchasers utilizing the Website and its interactive features; to facilitate the transactions between Company and Purchaser; to allow the Company and the Website to identify the Purchaser, and to allow Company to contact the Purchaser for customer service purposes and otherwise.  In addition, the Company requests Purchaser’s email address to confirm product purchases and to enable email or other electronic communications to be made through the Website. 

Purchasers may also provide credit card and other payment information through the Website.  The Company does not collect nor store this information, as is detailed above.  Rather, it is stored independently by a Payment Processor.

Moreover, the Company may utilize a Registered User’s email address to send updates, newsletters, news or other information regarding the Website to the Registered User.  In the event that a Registered User no longer wishes to receive such emails, they may “opt-out” via the “opt-out” function that appears in each email.  However, any such “opt-out” may impact the Registered User’s utilization of any services, discounts, or other offers that are available through the Website. By “opting out” of all emails from their account, the Registered User assumes all such risk.

Registered Users will be providing more Personal Information than general Users to the Website.  By becoming a Registered User, that User assumes all risk, and agrees to these terms with regard to all of the information that they submit vis-à-vis the Website.  Furthermore, the information provided by a Purchaser may be shared with other entities in order to facilitate the purchase of the Company’s products, and a Purchaser’s purchase of the products constitutes consent to sharing this information. In the event that a Registered User seeks to terminate their relationship with Company, they may affirmatively request that Company remove all of Purchaser’s personal data from their servers. Registered Users may also change information previously submitted to Company. Requests for the removal or alteration of Personal Information may be submitted through the “Contact Us” page of the Website.

PRODUCT REVIEWS/CONTACT FORM

When submitting a product review on the Website and/or contacting us, User may be asked to provide certain Personal Information, including their name and email address. This information is collected to make it easier for you to use the Website and its interactive features including, without limitation, sending messages to the Company, posting feedback on the Website including, without limitation, compliments, tips, complaints and/or comments; to allow the Company and the Website to identify the User; and to allow the Company to contact the User, if necessary. In that regard, the Company may use your email address to respond to your questions, issues, concerns, complaints, general inquiries, and/or feedback and/or to provide you with information you requested (“Responses”). The Company will retain your Personal Information for as long as necessary to provide you with said Responses and/or as necessary to comply with the Company’s legal obligations and/or to resolve disputes and/or enforce its agreements.

In addition, the Anonymous Information may be aggregated so that the Company may evaluate the overall use and traffic to the Website (the “Use History”).  This combined information may be shared internally within the Company.  By using the Website, the User is agreeing to their Anonymous Information being utilized in this manner. User assumes all risk, and agrees to these terms with regard to all of the information that the User submits through the Website.

User acknowledges and agrees that by submitting information on or through the Website, for example, by posting a review on the Website, such information, which may include Personal Information, may be public and viewable by other users of the Website. User shall not share any information on or through the Website that they are not prepared to be public or to otherwise share with such other third parties. 

All submissions of content including, without limitation, the posting of content to the Website or the submission of an inquiry sent to the Company, are accepted solely in accordance with, and governed by, the Website’s Terms and Conditions.  Per the Terms and Conditions, the Company has various rights to distribute such materials, content, business information, pictures, ideas, concepts or inventions that User submits to the Company through the Website or otherwise. If User seeks to keep such information or property private or proprietary, they should not submit and/or send such information through the Website or to the Company.

 

Information Sharing

Except as otherwise provided herein or within the Agreement and/or the Terms and Conditions of the Website, the Company will not intentionally distribute, rent or sell a User’s Personal Information to third parties without the User’s permission, except as outlined herein.

Notwithstanding the foregoing, the Company may share Users’ information, including, without limitation, Personal Information, amongst its service providers, but only to the extent necessary to complete the required activities of the Website. In addition, third-party plugins linked to the Website including, but not limited to, Facebook, Twitter, and Pinterest, may be granted permission to track User activity on the Website.

The Company may also disclose Personal Information about its Users or information relating to their use of the website for any reason if, in its sole discretion, it determines that it is otherwise reasonable to do so, including, without limitation:

  1. To comply with laws, such as without limitation, the Electronic Communications Privacy Act, regulations or governmental or legal requests for such information;
  2. To reveal information that is needed to identify, contact or bring legal action against any User who may be violating the terms and conditions of the Website;
  3. To take steps to protect and defend rights and property, including without limitation, intellectual property of the Company or that of third parties;
  4. To operate the Website properly;
  5. To protect the Website and its Users; and/or
  6. To fully cooperate with law enforcement authorities, private-party litigants and others seeking information about its Users to the extent required by applicable law.

In addition, information about the Users of the Website, including without limitation, Users’ Personal Information, may be disclosed in association with certain of the Company’s business dealings such as the exploration of any debt financing, acquisition or merger, sale of assets or ownership interests and in the event of a bankruptcy, assignment for benefit of creditors or receivership in which particular information could be sold or transferred to other parties as an asset.

The Company may also share Users’ Personal Information, Anonymous Information and Use History with potential business partners.

 

Security

The Company uses reasonable security measures that are designed to protect information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. The Company undertakes reasonable efforts to operate secure data networks, which are protected by industry-standard firewall and password protection systems.  The Company undertakes reasonable efforts to review its security and privacy policies on a periodic basis and it may adjust and change the systems as necessary. Please note, however, that no data security measures can be guaranteed to be completely effective. Consequently, the Company cannot ensure or warrant the security of any personal information or other information. You transmit Personal Information to the Company at your own risk. The Company is not liable for the privacy of email addresses, registration and identification information, communications, confidential or trade-secret information, or any other content stored on the Company’s equipment, transmitted over networks accessed by the Website, or otherwise connected with your use of the Website.  

 

International Visitors

This Website is generally intended for United States-based users. If you are visiting from or accessing the Website from other regions, the laws governing data collection and use may differ from United States law.  Please be aware that you are transferring Personal Information to the United States. The United States does not have the same data protection laws as some other regions. By providing Personal Information to us, you consent to the transfer of it to the United States and the use of it in accordance with this policy.
